PETITION TO THE FEDERAL ENERGY REGULATORY COMMISSION (FERC)
IN SUPPORT OF THE INVESTIGATION OF THE MAY-JUNE 2023
OPERATION OF KERR DAM/SQK PROJECT
PURSUANT TO FERC LICENSE P-005
WE the undersigned support a request to FERC to audit and investigate the operation of Kerr Dam/SQK Project P-005 during the months of May-June 2023 by Energy Keepers, Inc., the operator of the dam.
The purpose of this request is to identify if Energy Keepers violated its FERC license by any or all the following actions:
1. Release of water from Kerr/SQK beginning in May while Flathead Lake was filling and before it had reached full pool.
2. The failure to maintain full pool elevation after June 16, 2023, resulting in an overall two (2) foot elevation drop by mid-July.
3. The rate of filling and releases from Kerr/SQK during May and June and whether the ramping rates were exceeded.
4. The generation of significant hydropower in May while Flathead Lake was still filling.
